Residents of the center of Odessa, who have been complaining about noisy neighbors for a long time, intend to defend their rights in court. We are talking about the illegally built hotel "Bryk" in Mayakovsky Lane, 7, on the roof of which there is a disco. Lawyer Igor Shavrov told about it.

He noted that this building is an architectural monument. Earlier, GASK employees conducted several different inspections at the construction site, which became the subject of legal proceedings. In the main suit, which was considered in the Odesa District Administrative Court, GASK demanded to demolish the arbitrarily built object and restore the building to its original condition at the expense of the developer.

"The first two instances were rejected by GASC. The session of the appeals court was quite recently. Local residents found out about this and considered that their rights are also affected by this situation and they are ready to defend them in court. They can participate in court hearings as a third party with independent claims," ​​the lawyer said.

And he named the main arguments that can be discussed in this case.

"First of all, apartments that are adjacent to this building may lose their value because the view from the window has disappeared. Secondly, construction that takes place without proper control by state authorities, without a project, can damage neighboring buildings and lead to consequences that no one can predict. As we know, several houses collapsed in Odessa only in the last hour, including due to the unsuccessful actions of the builders. In this regard, local residents are concerned about what will happen to their homes. Therefore, citizens intend to exercise their legal right. I'm sure the court will still have its say in this process," Shavrov said.

At the same time, GASC also has the right to file a cassation case.

"Considering that the Supreme Court is quite busy, the approximate time of this process is about an hour. These are the realities of today's court proceedings," commented the lawyer.

In addition, according to local residents, loud music played and the hotel continued to work even during the strict quarantine. Odessa residents appealed to the law enforcement officers for help, but this did not bring results.

"These facts can also be considered within the framework of the process that was discussed, as the quality of life of residents who live in neighboring houses decreases and, accordingly, the investment attractiveness of their apartments decreases. No one wants to live next door to a discotheque. Local residents really have the right to participate in the court process, to present their arguments and arguments. And I am confident that this right will be implemented. We must understand that people do not want anything supernatural," Shavrov emphasized.

As a reminder, on October 12, Odessans outraged by loud music blocked the roadway at the intersection of Preobrazhenskaya Street and Mayakovsky Lane. And on March 17, the black magician Denys Malakhov organized a single picket near the Odessa City Hall with the request of local authorities to respond to the situation.
