The police withdrew the letter with the court's decision, obliging ISPs to block access to 426 sites

The police withdrew their cover letter to the NKRSI with a decision from the Holoseivskyi court, according to which providers are obliged to block access to 426 Ukrainian and Russian sites.

The police have already withdrawn their cover letter to the National Commission, which carries out state regulation in the field of communications and information," Gerashchenko wrote on his page in Facebook.

According to him, in December 2020, a citizen, Alexander Pan, turned to the police with a complaint about alleged fraudulent actions against him. "He really didn't like what was written about him on different Internet sites at different times, calling him a fraud," Gerashchenko noted.

He explained that after the reform of the criminal procedural legislation, the police is obliged to register any statements about the commission of a criminal offense, accordingly, it was also registered. "After that... Alexander Pan and his lawyers turn to the Holoseevsky district court with a request to impose an arrest on hundreds of Internet sites that at different times wrote something about him... Judge Plahotniuk on February 4, 2021 issues a decision on the recognition of 426 Internet sites... humiliating the honor and dignity of the Lord... and imposes arrest on them," explained the deputy minister.

Further, according to him, this court decision is sent to the police investigator, as well as to the National Commission, which provides state regulation in the field of communication and information. "No real actions that would cause damage to the owners of Internet resources were caused, except for the damage to public morals after such court decisions," the deputy head of the Ministry of Internal Affairs emphasized.

Speaking about the conclusions and recommendations that were made in connection with the current situation, Gerashchenko said that the police withdrew the accompanying letter to the National Commission.

According to the deputy minister, the criminal proceedings will be brought to the Main Investigation Department for verification and "in the absence of a crime, as well as by the decision of the investigator and the prosecutor, it will be closed according to the procedure provided for by the Code of Criminal Procedure."

As for judge Plahotniuk, according to Gerashchenko, victims of such a decision should file a complaint with the Supreme Council of Justice to examine the question of the judge's suitability for the position he holds.

"The conversation with Alexander Pan will be held separately," the deputy minister added.

In addition, he called on people's deputies to make changes to the Criminal and Criminal Procedure Codes, and to introduce investigative checks on citizens' applications "to weed out such custom cases." Also, the deputy minister believes that it is necessary to make changes to the legislation on information "to regulate the relationship between the press, the right to freedom of speech, the possibility of participants in journalistic investigations to protect their honor and dignity in a civilized manner if their rights were violated," Gerashchenko noted.
