To be or not to be: the work of electronic court proceedings was discussed in Odessa

A working meeting of the "Odessa Law Club" took place in the Odessa District Administrative Court

In the Odessa District Administrative Court, a working meeting of the "Odessa Law Club" was held with the chairman of the subcommittee on the implementation of EU decisions on human rights and alternative dispute resolution of the Committee of the Verkhovna Rada of Ukraine on legal policy, People's Deputy Roman Babi. The event was also attended by judges, lawyers, lawyers, and forensic experts.

The participants of the meeting discussed the problematic issues of implementation and regulation of the "Electronic Court", the launch and use of ECTS, as well as other topical issues of the functioning of the judicial system.

According to those present, the quarantine restrictions have a negative impact on the work of the courts. Many problems could be solved by the electronic court system, but it works unsatisfactory. At the meeting, it was noted that the electronic court in Ukraine was supposed to work an hour ago, but this issue was not fully resolved: in some courts, some functions of the electronic court are working, in others - not.

Separate question - court sessions online. To a greater extent, video conference sessions concern consideration of criminal cases. However, according to the lawyers, a number of important procedures, including interrogations, are difficult to conduct precisely in this format. In addition, not all courts have the necessary equipment for conducting court hearings by video conference.

It was also noted that the full transition to exclusively electronic court proceedings is a very expensive program. The participants of the meeting believe that it is necessary to calculate whether the implementation of an electronic court is worth the costs and efforts. In addition, the implementation of such a system requires significant legislative changes.

As noted by one of the founders of the legal club, the head of the "Union of Lawyers of the Odesa Region" Alexander Ryabets, the entire issue of electronic court proceedings was raised at the meeting, after which the participants developed their own proposals and comments, which will be the subject of consideration during the development and implementation of the ECTS software complex. People's deputy Roman Babiy emphasized that the meeting was quite constructive and he will take into consideration the proposals of the club participants.
