The Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations (USR) has become completely unprotected from unauthorized interference in its work by outsiders, the portal writes Fight corruption in Ukraine.
FCIU notes that unauthorized changes can be made there by anyone - public registrars, private notaries, hackers, etc.
On March 19, 2021, the state registrar D. Klymenko registered Serhiy Durach as the director of the CZI NGO. Three years later, Klymenko continues to work as a registrar, and the criminal case initiated on this fact is not investigated.
On November 26, 2021, notary T. Dombrovska reissued the corporate rights of two enterprises worth UAH 400 million to Serhiy Durach. Two years later, Durach continues to own this property, and notary T. Dombrovska was not punished. The criminal case initiated on this fact is not being investigated.
On November 13, 2023, state registrar Yu. Chernenko illegally canceled the decision of the general meeting of Dinare LLC and reinstated Serhiy Durach as director.
Already on November 24, 2023, the rights of the American corporation ANB International were taken from the owner by conducting registration actions with the simultaneous use of two keys and access to the EDR by two notaries. First, the application for the registration action was submitted to the Register on behalf of the state notary of Chernivtsi region, and after she blocked her key and access to the registry, the registration activity was completed by another private notary in Poltava region.
A complaint was filed against the actions of state registrars to the Ministry of Justice and it canceled the registration action, but on the grounds that it was committed outside the Odesa region, where the enterprise is located.
However, there is no mention of unauthorized access to the Register in the conclusions of the Collegium of the Ministry of Justice.
After complying with the order of the Ministry of Justice, ANB International restored its rights. However, two days later, a new attempt to seize the same corporate rights began.
On February 09, 2024, the state registrar of the Petroviriv village council of the Bereziv district of the Odesa region — Evgeny Borisovych Tkachenko — registered an application for changes to the EDR.
In other words, illegal actions with the EDR go one after the other. At the same time, the National Police does not investigate the criminal offense provided for in Part 5 of Art. 361 of the Criminal Code of Ukraine, despite the fact that "unauthorized interference in the work of information (automated), electronic communication, information and communication systems, electronic communication networks, committed during martial law" is a particularly serious crime. He is liable to imprisonment for a term of 10 to 15 years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.
