How to clear customs on a car with Euro plates in 2021: a lawyer's comment

According to preferential rules, within 180 days from the date of adoption of the law, it is possible to legalize only those cars that entered the territory of our country before the end of 2020.

Tens of thousands of Ukrainians are still driving around the country on European registration plates - the so-called "Europlates". But now, in May 2021, the President of Ukraine Volodymyr Zelensky signed the "law on Europlates" adopted by the Verkhovna Rada, which will finally put an end to the protracted process of legalizing such cars.

How to clear customs for a car with Euro plates in 2021, Igor Shavrov, a lawyer who manages the Shavrov and Partners law firm, told the ElitExpert agency.

He noted that according to preferential rules, within 180 days from the day of adoption of the law, only those cars that entered the territory of our country before the end of 2020 can be legalized.

"According to the established formula, the maximum tax rate for a gasoline car is five to nine years old and has an engine capacity of 2000 cubic meters. cm will be 500 euros. For a diesel car over 15 years old and with an engine capacity of 5000 cubic meters. cm will be 2750 euros," said the lawyer.

The grace period applies only to cars that have been manufactured for more than five years.

Vehicles for transporting 10 people or more and motorcycles are excluded from the preferential regime. Also, the regime does not apply to cars that do not meet the environmental standards "Euro-2" and higher or originate from the aggressor country.

In the event that cars imported before December 31, 2020 are located on the territory of Ukraine, but are not properly registered, their owners will need to pay UAH 8500 to go through the simplified registration scheme.

"If the owner of such a car does not plan to have it registered, he can take it abroad within six months, having previously paid UAH 8 to the state budget, which will allow him to avoid fines for such a violation," Igor Shavrov added.

The following documents are required for customs clearance of a car:

  • an invoice or other document confirming the value of the car;
  • a document confirming ownership of the car (agreement of purchase and sale, donation);
  • car registration document (technical passport);
  • a document confirming the fact that the car was removed from the register in the country of registration;
  • a document confirming the environmental standard of the vehicle (customs clearance of new cars is possible provided that they meet the environmental standards of at least EURO-5 and for those that have been in use at least Euro-2).

What to do to owners of cars that are already in Ukraine:

  • collect a package of documents,
  • write an application to change the customs regime "transit/temporary import" to the customs regime "import",
  • deliver the car to the nearest customs control zone,
  • will carry out customs clearance of the car.
