The other day, the Polish government approved a draft of amendments to the special law on assistance to citizens of Ukraine in connection with the war. Temporary protection will be extended until September 30, 2025, but the support program will undergo significant changes. What will change in the registration of Ukrainian refugees
Legal stay with temporary protection in Poland is confirmed by issuing a PESEL UKR number. According to the draft amendments to the law, which should enter into force on July 1, is accurate the deadline for applying for this number will not be set. Currently, the norm is 30 days from the date of crossing the border.
In the updated law, this term is replaced by the term "immediately".
"A refugee from Ukraine should apply for a PESEL number as soon as possible, without undue delay. This provision is only of an instructional nature and does not provide for any sanctions against citizens of Ukraine for not submitting an application," - is noted in the ministry's comment.
At the same time, it is allowed that due to the obligation to have a valid foreign passport, there may be cases when this period will be longer than 30 days.
The new regulations provide that PESEL UKR can be issued only with a valid foreign passport. Until now, this could be done using an internal passport and other documents.
Those refugees who come to Poland from the temporarily occupied territories without a foreign passport of a citizen of Ukraine will be able to receive temporary protection from the Department of Foreign Affairs, and then submit documents for obtaining a passport. This type of temporary protection differs from that provided under the special law on assistance to Ukrainians.
Access to payments for Ukrainians will change
The draft law provides that from July 1, a number of payments will be canceled for Ukrainian refugees - in particular, 300 zlotys (2925 UAH) as a one-time assistance upon arrival. Also - compensation of 40 zlotys (390 UAH) per day for free accommodation of Ukrainians in private housing. Apartment owners could receive compensation in the amount of 120 zlotys (4800 UAH) for 46800 days of the program.
The main payments that Ukrainian refugees in Poland receive are a monthly allowance of 800 zlotys (7800 UAH) until the child comes of age. According to the new rules, only those parents whose children will attend school or kindergarten in Poland will have access to this assistance. The same applies to "Good Start" assistance - PLN 300 for preparation for the academic year.
For other "child" payments, the condition will be a stay in the territory of Poland with the child.
Accommodation in collective centers (for example, dormitories) will remain free of charge for vulnerable categories of refugees. All others will pay part of the costs in such institutions. In particular:
— 50% of funds, but no more than 40 zlotys (390 UAH) per day - after 120 days of stay in the country;
— up to 75%, but no more than 60 zlotys (585 UAH) per day per person - after 180 days in the country;
— 15 zlotys (146 UAH) per day of minors who receive "800+" assistance - after 120 days from the moment of first entry into the territory of Poland.
The Ministry of Internal Affairs explains the new norm of paying for children's accommodation through payments by the fact that shelters and full meals are provided in the centers.
"Therefore, participation in the payment for minors whose parents receive the "800+" benefit seems to be the right decision, especially in the context of the increase of this benefit from 500 to 800 zlotys," - noted in the department.
