More than one and a half thousand residents of multi-apartment or multi-apartment houses at the address of the Gagarin Plateau, 5/2 may remain without heating this winter. All due to the fact that JSC "Odessagaz" does not want to re-sign a contract with a legitimate OSMD, which will make it possible to obtain fuel (gas) for two rooftop boiler rooms. They announced this at a conference in the "Odessit" press center.
The vicissitudes of this history have their roots in the distant 2007, when the future residents trusted the infamous company "Progress Stroy" and paid their "blood" at the expense of future "elite" housing in the Odesa Arcadia district.
The construction story ended after 11-12 years in 2018, when the second of the two houses was completed after a huge fire. Everything would be fine, but the company building the houses for the residents got a frankly weak infrastructure and a management company that, according to the residents, was imposed by the developer. We are talking about the "Prestige VII" housing and construction cooperative, whose director is Oleg Nevzorov, well-known to Odessa residents. According to the tenants, the cooperative headed by Nevzorov worked poorly, collected inadequate payment and simply made money off the tenants, being an unprofitable organization.
In 2019, the residents created the "Gagarynskoye plateau 5/2" housing development, which, like the infamous apartment buildings, went through "fire, water and copper pipes" before starting work.
In December 2020, the Supreme Court confirmed the legality of the creation of the Gagarin Plateau 5/2 OSMD and seemed to put an end to it. But JSC "Prestige VII" did not want to give up its unprofitable activity and continued to oppose the OSMD harshly. Only in the spring of this year, residents of OSMD managed to start servicing their own home.
However, the unprofitable housing association "Prestige VII" this time refused to compete with the "self-government" of residents and unleashed a real battle in the criminal and economic spheres, intending to return the "unprofitable" houses to its sphere of influence.
After the creation of OSMD, almost all suppliers of resources and services re-signed contracts with OSMD. Everything, but not JSC "Odessagaz", which is a monopolist in the field of gas distribution services in our city. Tenants associate their reluctance to sign a contract with OSMD with Igor Uchitel's close relationship with the director of the cooperative Oleg Nevzorov. They write about Ihor Uchitel's influence on the activities of the monopolist JSC "Odessagaz" - it is a waste of time, the topic is beaten and rubbed into holes.
"All service providers have renewed contracts with us, but Odessagaz, headed by Uchitel, since he is in a warm friendship with Mr. Nevzorov, our developer, refuses to renew the contract for heat with us," noted the representative of OSMD "Gagarynskoe Plateau 5/2" Alexander Rudnev.
Residents of Gagarinsky plateau, 5/2, complain that the house itself is poorly built, because of this they already need to heat their apartments so that they and their children stay warm and don't get sick. But now they can't do that.
The situation is not new for OSMD, in the summer of this year, the second monopolist of the Odesa services market JSC "DTEK Odesskie Elektrosety" in a similar situation asked for an explanation from the National Commission, which carries out management and state regulation in the field of energy and communal services (NKRE). NCRE answered unequivocally - it is necessary to conclude an agreement on the distribution and supply of electricity with OSMD.
The sphere of activity of the NERC and the binding nature of the latter's decisions extends to Odessagaz JSC, but the latter's reluctance to sign an agreement with OSMD under similar circumstances looks, to say the least, strange and inconsistent.
For their part, representatives of the cooperative say that without them, the local residents of the house on the Gagarinsky Plateau, 5/2 will not be able to enter the upcoming heating season, because the boiler rooms of the apartment building are their property and it is they who must heat the house.
But the documents provided by the tenants say the opposite, namely that the boiler rooms and their equipment were obtained by the cooperative from the previous developer and belong to all the tenants "by the right of joint ownership as common property of the house."
Note, journalists EliteExpert appealed to "Odessagaz" to clarify the situation. In their response, the gas representatives indicated that if there is a court decision in favor of the residents of the Gagarin Plateau, they will have no problems re-signing the contract with OSMD.
"Odessagaz" also claims that they have a valid contract with the cooperative, which they cannot unilaterally terminate, which is contrary to the practice of applying legal norms and explanations of the National Energy Regulatory Commission.
As of today, the residents of the house on the Gagarinsky Plateau, 5/2, have already applied to the NKRE. In the future, the residents plan to apply to the Antimonopoly Committee, which is obliged to apply sanctions in case of violation of the antimonopoly legislation of Ukraine.
"We will appeal to the Antimonopoly Committee due to the fact that "Odessagaz" is abusing its monopoly position on the natural gas distribution market. We officially presented a package of documents that confirm that we did not seize power in the house, but are a legitimate OSMD," explained OSMD lawyer Sergey Lupu.
Let us remind you that the current situation threatens that more than 1 citizens may spend the winter without heating. Among the residents of the house on the Gagarinsky plateau, 500/5 there are children, elderly people, and ATO veterans.
Meanwhile, in less than three weeks, the heating season will begin in Odessa. Ego was obliged to launch on November 1.
