The SBU's announcement of the suspicion of blogger Anatoly Shary cannot be the reason for the termination of the activities of Shary's Party. This was stated by the head of the OPORA Civic Network Olga Aivazovskaya v Facebook.
"The automatic termination of the party's activity cannot be the result of the actions of its individual member, leader, or even supervisor. The extrajudicial liquidation of a structure due to the handing over of suspicion to its leader, even for a serious crime, is not provided for by the legislation," she emphasized.
According to the Constitution of Ukraine, the formation and activity of political parties and public organizations whose program goals or actions are aimed at liquidating the independence of Ukraine, changing the constitutional system by force, violating the sovereignty and territorial integrity of the state, undermining its security, illegal seizure of state power, propaganda of war, violence , inciting interethnic, racial, religious enmity, encroachment on human rights and freedoms, health of the population, are prohibited.
At the same time, Aivazovskaya noted that the law "On political parties" provides that the Ministry of Justice can initiate a ban on the party in the event of a violation of the requirements regarding its activities established by the Constitution.
"Anatoly Shary formally does not head the legal entity of the political party named in his honor, and suspicion is not the same as an indictment," she added.
