How to get a deposit from a bankrupt bank after losing or replacing a passport

How to get a deposit from a bankrupt bank? This question concerns many Ukrainians (according to data for 2020, the number of defrauded investors in the country exceeded a million people). But for some people, the situation is even worse - how to get payments after losing or replacing a passport? Due to the imperfection of the legislation, until recently, people with such problems were forced to wait for years for a solution to their problem. Now the situation has changed.

In this regard, the "ElitExpert" agency turned to the well-known Ukrainian lawyer, the manager of the "Shavrov and Partners" law office, Ihor Shavrov. He told the algorithm of actions for those Ukrainians who had deposits in bankrupt banks. Now they can easily receive compensation payments from the Individual Deposit Guarantee Fund even after replacing their passport-book with an ID card or losing their passport.

There are situations when identity documents, in particular, a passport, are subject to replacement - either due to loss, or due to expiration (in the case of ID cards), or due to a change of surname, for example , after the conclusion of the marriage, whether for other reasons. Previously, in this case, it was very problematic to receive payments guaranteed by the state.

However, the process has changed now.

Stepan Bezrukov, an employee of the Odesa branch of the Guaranteed Deposits Fund of Individuals, explained the algorithm of actions to the "ElitExpert" agency:

"In the case of replacing a passport, the data of which are specified in the contract with an insolvent bank, in order to receive compensation from the Deposit Guarantee Fund, it is necessary to apply in writing to the Fund and provide the following documents: representations

a copy of the registration number of the taxpayer's account card (identification code)

a copy of a new passport or a second identity document certified by a personal signature".

In addition, the original or a notarized copy of the passport replacement certificate may be useful.

And in the event of a change of surname, first name, patronymic, you also need to provide a copy of the document (for example, a certificate of marriage / dissolution of marriage, change of name, etc.).

Stepan Bezrukov noted that the state guarantees reimbursement of bank deposits in failed banks in the amount of no more than UAH 200.

As of October 1, 2020, 74 out of 75 Ukrainian banks were participants in the Guarantee Fund (only the State Savings Bank is currently a participant in the Fund). However, at the beginning of September, the Financial Stability Board approved the entry of the Savings Bank into the Deposit Guarantee Fund from January 1, 2021.

The expert noted that the deposits of Oschadbank depositors are guaranteed by the state in full, i.e. 100%, regardless of the amount. But after joining the FGVFL, the amount of the guaranteed amount for new depositors will also be no more than UAH 200.

"In addition, at the beginning of September, the Financial Stability Board approved the debt restructuring mechanism of the Deposit Guarantee Fund, as a result of which the amount of payments to depositors of bankrupt banks can be increased from UAH 200 to UAH 000," the Fund employee noted.

It is worth noting that payments do not start immediately.

"The law stipulates that the liquidator must, within 20 working days from the day of revocation of the license from the bank, hand over the register of depositors to the Fund, and we will check it within a month and make a decision on the start of payments. That is, the Fund will start paying the reimbursed no later than two months after the start of the bank's liquidation," explained Stepan Bezrukov.

Important: if a person kept funds in foreign currency, they will still be returned in hryvnias - at the exchange rate that was set by the NBU on the day the license was revoked from the bank.

At the same time, in September it became known that in August, Ukrainian deposits in member banks of the Deposit Guarantee Fund increased by 1 billion 100 million UAH to 554 billion UAH.
