How to register a land plot in Ukraine in 2021: a lawyer's comment

It is necessary to take only five steps.

About how to register a land plot in Ukraine in 2021, the ElitExpert agency spoke with Igor Shavrov, a well-known lawyer who manages the Shavrov and Partners law firm.

"Many client stories begin like this - "my grandfather built this house in 1954..." After that, some old documents appear on the table - as if from a museum. In the lawyer's head, porridge begins: was there a register at that time? How to check these documents? Was there a Land Code then and what were its provisions?

You will be surprised, but you do not need a lawyer to register the land under your old house. All you need is desire, time and a little money. There are five simple steps that need to be overcome on this path," said Igor Shavrov.

First step: it is necessary to take a copy of the passport, a copy of the identification code and a copy of the document that confirms the ownership of the house. After that, you need to go to the village or city council with these documents (depending on where your land is located) and attach these documents to the application, which is submitted in two copies. One copy should be kept for yourself, as there is a mark on it that it has been accepted.

The application is written in the name of the chairman of the relevant council. In it, the following is described in free form: I, so-and-so, am the owner of a house at such-and-such address and I am asking for permission to set aside a plot of land that is located under my house with an approximate area of so many acres, your date and signature.

The law states that the relevant council must decide what to do with your application within a month, but in reality, practice shows that the application goes through a bureaucratic process from two to five months. You can take the secretary's phone number in the council where the application was submitted to periodically find out at what stage your application is being considered.

"Similar applications are voted on at the session of the relevant council. And after receiving the decision, you need to go to the land developer to develop the appropriate land documentation," concluded Igor Shavrov.
