How will they defend their right to silence if the neighbors make too much noise

The amount of the fine will increase with each arrival of the police.

Igor Shavrov, a lawyer who manages the Shavrov and Partners law firm, told the ElitExpert agency what to do if the neighbors violate the noise regulations:

"Legally, loud music, the use of household tools, fireworks, and the like are classified as noise. If you yourself want to work with a perforator, then you should be sure that you have chosen the right time for this.

Doing repairs, knocking, sawing, working with a jackhammer is prohibited 21.00 to 08.00. If we are simply talking about loud noise: singing, loud music, shouting, etc. — then 22.00 to 08.00. In addition, starting any construction or repair work, you are obliged to warn your neighbors or residents of nearby territories", the lawyer emphasized.

In addition, Igor Shavrov notes that the legislation defines the punishment that a person can incur for ignoring the "silence regime". Failure to comply with the rules established by law will lead to administrative liability, and the amount of the fine will increase with each arrival of the police.

"For the first time, the fine will be from 85 to 255 hryvnias, for the second - from 255 to 500 hryvnias, and no one will protect you from confiscation by the police patrol of the same equipment that makes a loud sound.

But the rules for enterprises are slightly different, and the fine that will be paid by entrepreneurs is significantly higher. The first time: from 255 to 500 UAH, the second - from 850 to 2550 UAH, and again, if necessary, with the confiscation of equipment. Further violation of the rules will lead to the drawing up of a report by the police and a summons to the courtIgor Shavrov concluded.

The lawyer also noted that there is another effective way to protect against noisy neighbors.

"For a systematic violation of the silence regime, any tenant has the right to file an application in court for compensation of moral damage. True, such a fact must be proved, and it can be done in many ways. The most safe and effective method is the drafting of a report by police officers. Then - audio and video recording, but it should be taken into account that the court will not consider them as something serious without other evidence in total. And of course, the main evidence in court can be an ecological examination, which can be ordered privately from a state expert.

 And finally, I just want to remind you that we live not only according to the principles of written laws, but also based on our moral values ​​and principles, which ideally should not contradict the laws, but only complement them." Igor Shavrov concluded.
