What is known

The Verkhovna Rada is working on a new draft law on mobilization in Ukraine. In particular, it may be about the requirements for deferment and rules for students, but the final text is not yet available.

The current list of the main changes that may be made to the law on mobilization. Namely:

1. New additional leave with preservation of financial support duration of 90 calendar days to servicemen who have been released from captivity (except for those who have refused further service and wish to be released).

2. New duties for conscripts regarding:

— mandatory medical examination and treatment in accordance with the decisions of the VLK;
— possession of military registration documents, which must be presented at the request of an authorized representative of the TCC and SP.

3. New grounds for dismissal:

— at their own request for foreigners and stateless persons;
— in connection with release from captivity (except for those who voluntarily surrendered to captivity)
— in connection with early termination of the contract for female cadets;
— in connection with the presence of a disability of the I or II group;
— in connection with organizing events in intelligence agencies, SBU, UDO)

Today, in addition to the specified new grounds, military personnel during martial law have the right to resign from military service on the following grounds:

— by age — upon reaching 60 years of age;
— according to the state of health - according to the decision of the VLK on unfitness for military service with exclusion from military registration or on unfitness for military service with a review after 6-12 months;
— in connection with the entry into legal force of the indictment of the court, which imposed punishment in the form of deprivation of liberty, restriction of liberty;
— due to family circumstances or other valid reasons (if servicemen have not expressed a desire to continue military service).

4. The right to a postponement of conscription for military service for teaching staff institutions of vocational pre-higher education

5. The right to military service for persons with disabilities (at their request), despite their presence grounds for postponement of conscription during mobilization

6. The number of citizens who have the right to deferment is decreasing for the care of a person with a disability of the I and II groups or who requires constant care, to family members of the first degree of kinship, and eliminating the possibility of evading the draft during mobilization by issuing fictitious care for persons who need it.

7. The procedure for granting a deferment from the draft to citizens who obtain preliminary and higher education is being changed.
To date, according to the legislation of Ukraine, citizens who are studying regardless of the already existing education and its level, have the right to postpone the draft for mobilization. Thus, the number of those wishing to study during martial law increased by 2-3 times not only in connection with the reasons for raising their professional level, but also to avoid conscription for military service. The changes are intended to eliminate the possibility of avoiding the draft by obtaining a second, third pre-higher or higher education.

8. The list of persons registered for military registration is being expanded, in particular:

— who completed military service in other states before acquiring Ukrainian citizenship;
— who were convicted for committing a criminal offense to deprivation of liberty, restriction of liberty, including with exemption from serving the sentence;
— who, after graduating from institutions of higher education, were awarded military (special) officer (middle management) ranks or who received military officer ranks after undergoing military training under the reserve officer training program.
