On August 15, 2023, NABU and SAP exposed 5 people - members of an organized group that took over 1200 hectares of land near Kyiv. Their actions led to more than UAH 1,8 billion in losses to the state, official sites of both clubs report in the department.
Among the suspects:
- former deputy head of SE "Main Research and Design Institute of Land Management" — organizer of the scheme;
- two former officials of the State Geocadastral State Administration in Kyiv region are the perpetrators of the crime (one of them is currently the head of one of the Centers for Disease Control and Prevention);
- two natural persons connected with the ex-management of the State Geocadaster are accomplices of the crime.
Actions of persons qualified under part 5 of Art. 191, Part 3 of Art. 209 of the Criminal Code of Ukraine.
According to the investigation, in 2018-2019, the organizer of the crime, having influence on the officials of the Main Department of the State Geocadastre in the Kyiv region, as well as connections with high-ranking officials in various spheres, developed a scheme for acquiring agricultural lands that were in permanent use by state enterprises in the territory of Kyiv region For this, he involved other co-conspirators who, among other things, searched for ATO participants who have the right to receive a plot of land free of charge.
Detectives and prosecutors established two episodes of criminal activity - the seizure of almost 920 hectares of state land in Fastov and about 284 hectares of the state-owned enterprise "Pushka-Vodytsia" near the city of Kyiv.
NABU noted that among the suspects is a former official of the State Geocadastral State Administration in Kyiv region, who is currently the head of one of the central executive authorities.
Most likely, the law enforcement officers mean the so-called Heads of the State Reserve Agency of Ukraine Babaka Dmytro Anatoliyovych, who previously headed the main administration of the State Geocadastre in the Kyiv region.
According to NABU, the participants in the crime ensured the inventory of land plots on the territory of the city of Fastova, which were in permanent use of the State Enterprise "DG "Dmytrivka", which is under the auspices of the National Academy of Agrarian Sciences.
The perpetrators entered false information into the documentation compiled based on the results of the inventory, where they indicated that the right to use the land plots was absent, allegedly due to the liquidation of the state enterprise and the absence of a legal successor, and therefore the plots were classified as reserve lands.
In the future, the participants of the crime, without the knowledge of the participants of the ATO, took advantage of the relevant legislative mechanism and allocated land plots in their names for private ownership, which were in permanent use of the State Enterprise "DG "Dmytrivka".
Subsequently, after the privatization of the land, it was resold to third parties officially at a price 10 times lower than the market value. According to the examination, the land plots were worth almost 715 million UAH, while they were transferred to private entrepreneurs for the amount of about 85 million UAH.
The perpetrators also allocated plots of land on the territory of the Sofiivsko-Borshchagivska and Petropavlovsk-Borshchagivska village councils of the former Kyiv-Sviatoshyn district of the Kyiv region, with a total area of 284,32 hectares and a market value of almost 1,2 billion UAH.
The peculiarity of this scheme was that, based on the results of the inventory, SE "Pushka Vodytsia" registered the right to use land plots in 2016. In 2019, SE "Pushka Vodytsia" developed appropriate documentation for the division of part of the plots, which was approved by the State Geocadastre State Administration in Kyiv region.
However, the suspects, trying to take possession of the specified plots, prepared a complaint to the Ministry of Justice on behalf of the Main Department of the State Geocadastre in the Kyiv region regarding the cancellation of the registration of the right to use the land plots of the State Enterprise "Pushka Vodytsia", since their division was carried out, allegedly without the consent of the State Geocadastre as a representative of the state - the owner land plots.
After the Commission for Review of Complaints in the Field of State Registration of the Ministry of Justice made a decision to cancel the decision of the state registrar, which registered the right to permanent use of land for the State Enterprise "Pushka Vodytsia", the right of use itself was not canceled.
However, the attackers later ensured that the employees of the Main Directorate of the State Geocalastr in the Kyiv region transferred the specified plots into private ownership in the name of the ATO participants, most of whom did not even know about the exercise of their right.
A change of purpose and further sale to private companies was also planned here. However, thanks to NABU and SAP, in 2020-2021, all lands were seized and a ban was issued against their development, change of purpose, etc., which allowed them to be preserved for the community of Kyiv region.
Detectives and prosecutors are identifying other possible participants in the crime. NABU and SAP are also investigating the facts of forgery of documents regarding the representation of the interests of ATO participants.
