NABU does not want to remove Sytnyk, despite the court's decision

The National Anti-Corruption Bureau does not want to implement the decision of the Kyiv District Administrative Court

The National Anti-Corruption Bureau does not want to implement the decision of the District Administrative Court of Kyiv to remove Artem Sytnyk from the position of Director of NABU.

This was reported in the press service of the bureau.

— The decision of the District Administrative Court of Kyiv on the activities of the National Bureau and the director of NABU is involved and absurd in the legal sense. The National Bureau considers the decision of OASK on October 26 as an interference in its work and will certainly appeal against it, the NABU said.

It is also clarified that the court decision obliges the Cabinet of Ministers to identify a separate minister and send him to NABU to coordinate the activities of the institution, and the National Security and Defense Council to take control of the activities of the National Bureau and contains a number of other instructions, including deputy directors of NABU.

NABU also declares that the removal from the post of director of the Bureau can occur only on the grounds provided for by the Law "On the National Anti-Corruption Bureau of Ukraine". And, there they believe that there are no such grounds. 

In addition, the head of the Ministry of Justice of Ukraine Denys Malyuska said that now there is no legal basis or authority to exclude information about Artem Sytnyk as the director of NABU. According to him, the Ministry of Justice cannot make changes to the Unified State Register in order to implement any decision of the Constitutional Court of Ukraine or private determination.

— Changes to the information contained in the registers are made by state registrars, and the Ministry of Justice only considers complaints about the actions of registrars and enters data into the EGR exclusively based on the results of considering such complaints. The times when the Ministry of Justice had a Registration Service and registrars are long gone, the minister emphasized.

Thus, according to Malyusyka, there is no legal basis and authority to exclude information about Sytnyk as the director of NABU from the EGR. As a reminder, the District Administrative Court of Kyiv decided to remove Artem Sytnyk from the position of Director of NABU and, in particular, ordered the Ministry of Justice to remove him from the Unified Register as the head of NABU.
