Pitfalls of compulsory vaccination: to vaccinate children or not?

Recently, the European Court of Human Rights issued an unprecedented decision.

In Ukraine, they are talking about vaccination again, and this time thanks to bill 4142, which was supposed to regulate the procedure for vaccination of Ukrainians. A little later, "Servant of the People" announced that this point had been removed from the document. However, the question remains the same - will children be able to attend educational institutions without vaccinations, and will it be necessary to enroll them as adults? There are two sides to this. For example, according to the Constitution, Ukrainians are obliged not only to take care of their health and the health of their children, but also not to harm the well-being of other citizens by undergoing preventive medical examinations and vaccinations. Also, according to the law "Basic legislation of Ukraine on health protection", mandatory medical examinations, preventive vaccinations, medical and quarantine measures can be carried out in relation to certain particularly dangerous infectious diseases. What is the content of the document?

- One of the points of this draft law was mandatory vaccination of all citizens. But, in the first reading, this point was removed from the document. That is, taking it as a basis, the mandatory vaccination of the entire population of the country, including representatives of certain professions, and the creation of a special body to control the epidemic well-being of the population were refused. But, at the same time, the disease control body was proposed to be created "on the ground". However, this draft law now regulates the procedure for introducing quarantine, and the Cabinet of Ministers will deal with it. - says Igor Shavrov, a lawyer who manages the Shavrov and Partners law firm.

However, recently the European Court of Human Rights issued an unprecedented decision - it found the administrative punishment of parents for refusing to vaccinate their children according to the vaccination calendar to be legitimate. This is the first decision of the ECHR in the history of the issue of compulsory vaccination of children, which is being fought by a small but extremely active minority in many countries of the world, including Ukraine. However, Themis is unshakable - the decision is final and cannot be appealed.  "The goal should be to protect every child against serious diseases, through vaccination or collective immunity," - says the decision.

At the same time, it is also noted that this has nothing to do with the coronavirus pandemic - the proceedings began back in 2013-2015, when it was about scheduled vaccination in Europe.

— The statement of the Supreme Court clearly states: if any parent does not want to vaccinate a child, the right of other vaccinated children (who make up the critical mass) to a safe environment is violated. At the same time, if a student is not admitted to school without vaccination, his right to education is violated. It is important to understand one thing: according to the Supreme Court, the right to health is greater than the right to education. Moreover, there are other alternative ways of learning, besides physically visiting an educational institution, – summarized by Igor Shavrov.
