The Cabinet of Ministers submitted to the Council a bill that exempts the manufacturer of vaccines from any responsibility for the consequences of their use.

The Cabinet of Ministers proposes to amend Article 9-2 of the Law of Ukraine "On Medicinal Products". The explanatory note to the bill states that such a decision is due to Ukraine's participation in the COVAX program, thanks to which the country will receive a vaccine against the coronavirus.
The authors of the document indicate that the Covid-19 vaccines were developed in the conditions of a pandemic, which are considered emergency, therefore the participants of the COVAX mechanism agree to exempt vaccine manufacturers from responsibility for certain risks that may arise as a result of the use of these vaccines.
The Cabinet of Ministers proposes to include the following clause in the law on medicinal products:
"After the state registration of vaccines or other medical immunobiological preparations for the specific prevention of the coronavirus disease (Covid-19) under the obligation for emergency medical use, the central executive authority, which ensures the formation and implementation of the state policy in the field of health care, by decision of the Cabinet of Ministers of Ukraine, has the right to accept obligations on behalf of Ukraine related to the use of vaccines or other medical immunobiological preparations for the specific prevention of the coronavirus disease (Covid-19), the state registration of which is carried out in accordance with the requirements of this article, including the waiver of sovereign immunity in possible disputes regarding such obligations, as well as the release from civil liability of the manufacturer and/or the owner of the registration certificate, including their employees, medical workers involved in the implementation of the measures, with connected with vaccination, for any consequences caused by the use of such vaccines".
