The new bill on mobilization is the latest news

The document provides for a number of changes

On December 25, the Cabinet of Ministers submitted to the Verkhovna Rada bill On the improvement of mobilization and military accounting. The document envisages a number of changes — from lowering the mobilization age to liability for failure to appear at the military commissariat. Now parliamentarians will work on it, ahead of it is consideration in committees and voting in two readings.

It should be noted that the text of the draft law is currently available on the parliament's website, which is currently only being discussed. After the adoption of the document, the law will enter into force in a month, with the exception of certain parts.

So, among the innovations of the new draft law:

— changing the conscription age from 27 to 25 years,
— military personnel after capture — 90 days of leave,
— involvement of administrative service centers, employment centers, and recruiting centers in military recruitment activities,
— basic military service for persons aged 18 to 25,
— basic military training, which is included in the curricula of universities of all forms of ownership as a separate educational discipline.

Among the powers of village, settlement, city councils are now, in particular:

— ensuring the organization of the draft,
— provision of personal primary military records of conscripts on the territory of populated areas,
— alerting and ensuring the arrival of citizens who are involved in the fulfillment of the obligation to mobilize equipment to assembly points and military units,
— ensuring the planning and implementation of mobilization training, mobilization and demobilization events on the territory of the relevant settlements.

Summons and e-mail

In the case of receiving a summons to the TCC, the citizen must appear at the place and time specified in it.

What should be in the summons:

— surname, patronymic and date of birth
— the name of the TCC that issued the summons
— the purpose of the call
— place, day and time of appearance on call
— signature (electronic digital signature) of the official who issued (formed) the summons
registration number of the summons
explanation of the consequences of non-appearance and the obligation to report the reasons for non-appearance.

The summons can be served: where and by whom

— in the premises of the TCC — representatives of the TCC
— at the place of residence — representatives of the TCC or policemen;
— at work — representatives of the TCC, the employer or a police officer;
— in public places — representatives of the TCC or police officers.

Important reasons for failure to appear on a summons are an obstacle of a natural nature, illness, death of a close relative.

During mobilization, citizens of Ukraine between the ages of 18 and 60, who are on military registration or removed from it, must carry a military registration document and present it at the request of a representative of the TCC or a police officer. During the document check, a representative of the TCC or a police officer may take photos and videos and use equipment with access to the register of conscripts.

Postponement
The following have the right to a postponement, in particular:

— reserved, women and men who have three or more children under the age of 18,
— women and men who independently raise a child (children) under the age of 18,
— persons with disabilities of group I or II, or who have a wife (husband) or one of their parents from among persons with disabilities of group I or II,
— women and men who have a child (children) under the age of 18 and a husband (wife) who is in military service,
— women on maternity leave up to 3 years (if necessary, up to 6),
— pregnant women,
— acting People's Deputies and deputies of the Verkhovna Rada of the Autonomous Republic of Crimea.

Regarding students, According to the new draft law, the applicants of professional (professional-technical), specialist pre-higher and higher education, who study full-time or dual forms of education and obtain a level of education that is higher than previously obtained in one specialty (major), are not subject to the draft.

Dismissal from service
During martial law, contract service for persons aged 18 to 25 is one year.
Reasons for exemption from military service for conscription, in particular:

— release from captivity
— election as a people's deputy, a deputy of the Verkhovna Rada of the Autonomous Republic of Crimea
— the end of the term of service — in the case of continuous service during martial law for 36 months.

The mobilized are released from service, in particular, in the following cases:

— in case of reaching the maximum age for military service,
according to the state of health,
— on the basis of the conclusion of the VLK on unfitness for military service (possibly with a review after 6-12 months),
— in the presence of disability of the I or II group,
— in connection with the entry into legal force of a guilty verdict of the court, which imposed punishment — in the form of deprivation of liberty or restriction of liberty,
due to family circumstances,
— in connection with organizing events in the intelligence agencies of Ukraine,
— in connection with release from captivity,
— in connection with the reduction of staff,
— in connection with the election as a people's deputy of Ukraine, a deputy of the Verkhovna Rada of the Autonomous Republic of Crimea,
— in connection with the end of the term of service — in the case of continuous service during martial law for 36 months.

Military accounting and restrictions
The draft law stipulates that a military registration document is created in electronic form for each conscript, conscript and reservist. With, the rule according to which the military registration of citizens of Ukraine permanently living abroad is not kept is excluded.

In addition, conscripts, conscripts and reservists who left their place of residence will be required to register for military registration at their place of residence within seven days from the date of registration of IDPs.

Another suggestion is that convicted persons can be called up for military service, except for those who have committed crimes against the foundations of national security, as well as crimes provided for in Articles 401-414, 426-433, 436, 437-442 of the Criminal Code.

Ukrainians abroad
Consular services in diplomatic missions of Ukraine abroad for male Ukrainians aged 18 to 60 who are conscripts, conscripts or reservists, are carried out on the condition of having military registration documents. The consulate checks the validity of military registration documents. The exception is the processing of documents for return to Ukraine, assistance to children, processing of inheritance, services at the request of detainees, in the event of a threat to the life and health of a citizen.

Under martial law registration of a Ukrainian or foreign passport abroad for male citizens of Ukraine between the ages of 18 and 60, provided they have military registration documents.

Restrictions for dodgers

According to the proposals, petitioners will be entered in the Unified Register of Debtors, and the following restrictions will apply to them:

— ban on traveling abroad,
— a ban on transactions with movable and immovable property,
— restrictions on the right to drive one's own vehicle and obtain a driver's license,
— restriction of the right to use and dispose of funds and other valuables,
— refusal to enter into a credit agreement, loan agreement,
— suspension of benefits and services from the state.

Such restrictions will be terminated upon notification of the head of the TCC regarding the exclusion of a conscript from the Unified Register of Debtors.
