The Court of Cassation overturned Zelenskyi's decree on the removal of Tupytskyi from the post of head of the KSU

This decision can still be appealed.

The administrative court of cassation, part of the Supreme Court, recognized as illegal and annulled the decree of the President of Ukraine on the removal of Oleksandr Tupytskyi from the position of head of the Constitutional Court of Ukraine.

According to the Supreme Court, the decision was made on July 14.

The Supreme Court clarified that the President of Ukraine in his decision violated the law and exceeded his powers, "violated the guarantees of independence and inviolability of judges of the Constitutional Court of Ukraine established by the Constitution and laws of Ukraine," the Supreme Court summarizes.

We note that this decision can still be appealed in the Grand Chamber of the Supreme Court.

Let's recall the background of the events. On December 29, 2020, Zelensky signed a decree on the removal of the Chairman of the Constitutional Court, Oleksandr Tupytsky, from the position of judge of the Constitutional Court for a period of two months. However, the very next day, December 30, the court declared that they considered Zelensky's decree on Tupytsky's removal to be "legally void", called for its cancellation, and Tupytsky continued to perform his duties.

On January 19, the FBI announced that it informed Tupytsky about suspicion of crimes under part 2 of article 384, article 386 of the Criminal Code (knowingly false testimony, connected with the artificial creation of defense evidence, bribing a witness to refuse to give evidence). On February 1, it became known that the President's decree on the removal of Tupytsky is being challenged in the Supreme Court.
