A resident of Odessa drew up a will for the judge to appeal to her

Such circumstances pose a threat to judicial independence, the Supreme Judicial Council believes.

In Odessa, a man bequeathed part of his property to the judge of the Kyiv District Court, Iryna Ogrenych, in order to have a reason to appeal to her. About this сообщил Supreme Council of Justice.

"The defendant drew up a will for the fate of the household in favor of the judge, on the basis of which he appealed to her. Ogrenych noted that the will was drawn up by the defendant a few days before he submitted an application to recuse the judge from hearing the case. According to Ogrenych, in this way the defendant wanted to influence her as the presiding judge in the specified case," the message says.

The Supreme Council of Justice believes that such circumstances pose a threat to judicial independence, because they can be a way of influencing the court, and asked the Prosecutor General's Office to open criminal proceedings under the article on interference in the activities of judicial bodies (Part 1 of Article 376 of the Criminal Code of Ukraine).

As is well known, the basis for impeachment of a judge in a civil process is a family relationship with the participants in the process; participation of the judge in the case in a second role (witness, expert, etc.); direct or collateral interest in the result of consideration of the case; violation of the order of determination of the judge for consideration of the case; other circumstances that call into question the judge's impartiality or objectivity.
