It is also stated in court documents that the wife issued a gift in the name of her husband in the amount of 16,9 million hryvnias, 330 thousand euros and 200 thousand dollars. However, the administration of the State Tax Service in the Odesa region decided to impose a tax of 13,4 million hryvnias on this operation.
Since gifts between persons of the first degree of kinship (correspondingly, between spouses) are not subject to taxation, the Odesa District Administrative Court found such a decision unlawful and ordered to reimburse the plaintiff the specified amount.
