The government supported the draft law on NABU, which will terminate Sytnyk's powers

The Cabinet of Ministers of Ukraine approved the draft law on the National Anti-Corruption Bureau of Ukraine, which terminates the powers of Artem Sytnyk as director of NABU.

The Cabinet of Ministers of Ukraine approved the draft law on the National Anti-Corruption Bureau of Ukraine, which terminates the powers of Artem Sytnyk as director of NABU.

This was announced by the Minister of Justice of Ukraine, Denis Malyuska, on his Facebook page.

"With its two decisions, the Constitutional Court of Ukraine declared unconstitutional the decree on the appointment of Sytnyk as the director of NABU and the provisions of the law on NABU regarding the participation of the President in the selection and appointment of the director of NABU. The government faced the task of closing the loopholes in the law and regulating the status of NABU and its director," Malyuska wrote.

According to him, the first approach to the barrier was draft law No. 4437 — in it, the government (in order to avoid anyone doubting the legitimacy of the NABU director) proposed at the level of law to grant Sytnyk the powers of the NABU director until a new director is elected according to a new procedure.

"Unfortunately, No. 4437 did not receive support in the parliament. At the same time, the problem of "holes" in the legislation and status of NABU remained, and its closure is one of the conditions of cooperation with the IMF. Therefore, the government made a second approach — a new draft law that grants NABU the status of an executive authority and a new procedure for electing the NABU director. Also, a separate provision of the draft law specifies that during the selection process of the new director of NABU, the director's powers will be exercised by the first deputy director of NABU," Malyuska explained.

Yes, Malyuska noted that if the status of NABU as an institution can be put in order only by reducing Sytnyk's term of office, then such an option should not be rejected.

"Especially because of the independence and impartiality of Gizo Uglavy as Acting nobody seems to doubt it. The discussion about the content of the bills will continue, but already in the parliament," Malyuska added.
