The Cabinet of Ministers proposed strengthening criminal liability for torture

The government supported the draft law "On Amendments to the Criminal Code of Ukraine on Criminal Liability for Torture" prepared by the Ministry of Justice. This was reported by Deputy Minister of Justice Alexander Banchuk.

"This bill was developed with the aim of bringing the provisions of the Criminal Code of Ukraine into line with the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment and Punishment," Banchuk noted.

According to him, it is proposed to consider any intentional action aimed at causing severe physical pain or moral suffering to a person, performed with the aim of forcing him or another person to commit actions contrary to their will. Including - to receive information or recognition.

The draft law also provides for increased liability in the form of deprivation of liberty for a period of 7 to 12 years with deprivation of the right to hold certain positions or engage in certain activities for a period of up to three years in the event of torture by a representative of the state, including a foreign one.

"Exemption from criminal liability due to the expiration of the statute of limitations and exemption from serving a sentence due to the expiration of the statute of limitations for the execution of an indictment sentence will not apply to these categories of persons," the Deputy Minister of Justice emphasized.
