Poland changed the rules of temporary protection for refugees from Ukraine

The provisions of the special law on assistance to Ukrainians in Poland can be extended only until June 30, 2024. Those who plan to stay in the country for a longer period have become more active in applying for residence permits.

Such a right is given by a job or one's business in Poland, the migration platform EWL said.

How will the changes affect refugees working in Poland

Ukrainian refugees who want to continue to stay in Poland and have a job or business in this country will apply for a temporary residence permit in Poland (the card is broken), says the director of international recruitment of EWL Marcin Kolodziejchyk.

"This opportunity is available for citizens of Ukraine with PESEL UKR status from April 1, 2023, if they have a job, business in Poland or are highly qualified employees." - explains the expert.

Some employed Ukrainian refugees sign employment contracts before the end of their legal stay in Poland (temporary protection). After it ends, they can either stay in Poland, having filed for a crime card, or return or leave to another EU country.

"Most Ukrainian refugees and labor migrants currently sign employment contracts for one or two years. We are talking about those who decided to stay in Poland for longer. They are now using temporary protection, but later they can also submit documents for a beaten card." - draws attention to Marcin Kolodziejchyk.

According to him, Ukrainians became more active in applying for a temporary residence permit back in December, when it became known that Poland may not extend temporary protection until 2025.

"These are the ones who want to stay longer. For them, the beaten card guarantees a legal stay in the country from 1 to 3 years." - says the specialist.

Will Ukrainians leave for other countries?

Ukrainians who can support themselves financially and have grounds for legal stay and obtaining a residence card (on the basis of work, reunification with family or for other reasons) will stay in Poland, according to the director of international recruitment of EWL.

"The question of whether to stay or leave may arise before Ukrainian refugees who do not have a job in Poland or the opportunity to work (women with children or vulnerable categories), but temporary protection will probably be extended for them. It is worth waiting for the adoption of the draft law and understanding exactly what changes it will introduce." - notes Marcin Kolodziejchyk.

He adds: a possible reduction of the terms of stay and limitation of categories for issuing temporary protection will encourage those citizens of Ukraine who abused the status of temporary protection in Poland to leave for other EU countries or return home.

"These are those who used it, but spent a significant part of their time in Ukraine and received assistance of 800+ per child (payments of 7490 UAH per month, - ed.) or worked in another European country", - notes the expert.
