Criticism of judges should be constructive so as not to undermine people's trust in the courts and worsen the situation

The judicial system in Ukraine needs to be reformed gradually. Such a decision will prevent personnel shortage in the courts and will not leave the system of qualified specialists. This was stated during the international conference in Kyiv by the leading Washington lawyer on international disputes, who represents domestic and foreign clients in US courts and international arbitrations, Jean Burt, writes "Judicial and legal newspaper».

"I can say, having lived in the USA for many years and practicing law for more than 20 years, there is no flawless judicial system anywhere. Ukraine is advancing in the development of judicial proceedings. I really appreciate all requests to improve the system further and further. However, it should be taken into account that judges, lawyers and prosecutors who are in the system have experience and know how to work in it. And when the system is changed quickly and abruptly, it becomes difficult for the subjects of the system to work in such conditions. My advice is to not stop trying to do better in the future, but to do it consciously and gradually," said the lawyer.

At the same time, the second participant in the conversation, Pavel Gorbasenko, judge of the Economic Court of the Kyiv region, noted that the criticism of judges should be constructive, so as not to undermine people's trust in the courts and worsen the situation.

"Objectively, public control should be in the judicial system, but constructive, which gives an impetus to the judicial system to improve itself. If criticism is not constructive, trust is destroyed," he emphasized.

We note that the second international conference "Dialogues on Justice-2" took place in Kyiv. It was attended by more than 30 people, including people's deputies of Ukraine, judges of higher courts, leading lawyers, MEPs and specialists from Europe, the USA, and Israel.

In particular, the participants discussed issues directly related to the consequences of judicial reforms in Ukraine: understaffed courts and ways to solve the personnel problem; ensuring the independence of judges from political influence and pressure from law enforcement agencies; the solution to the problem of justice in Ukraine involving foreign citizens and public activists in the assessment and selection of judges from the point of view of international experience, as well as the creation of a single and integral model of judicial reform in Ukraine.
