Inaction of Themis: in Odessa, the prosecutor's office delays the trial of a Turkish citizen

The man came to Odessa for the Tango Festival.

In June of this year, a Turkish citizen, Murat Aydogda, was detained at the Odessa airport. A 46-year-old man was found in his clothes with 0,5 g (1,2 g including the bag) of marijuana. He claims that he did not take anything like that on the road. The SBU took up the case, then it was transferred to the regional prosecutor's office. 

Until now, the courts are still going on in this case - prosecutor Yu.V. Bachynskyi is delaying the process in every way instead of completing the trial. 

Prosecutors charge a citizen of Turkey with drug smuggling. He faces up to 8 years in prison with confiscation of property.

In practice, such cases end with a fine of UAH 30. For example, in Odessa, over the past 000 years, judges have considered about a dozen cases of drug smuggling through the airport. In all cases, the court decision ended with a fine. 

It is known that a man came to Odessa for the Tango Festival. Dancing is my hobby. Currently, Murat has no means of subsistence, and there is no possibility of employment in Ukraine. He is under the care of tango teacher Andrey Vozniuk, who decided to help the man. According to him, the prosecutor is trying by all means to delay this case in order to receive a bribe. He left without consideration the lawyer's request to plead guilty. Due to his own fault, the trial was postponed several times - sometimes he did not appear, sometimes he did not take the case materials. 

The judge of the first instance handed down a sentence - a fine of UAH 51, but the prosecutor also appealed against it for some reason. It is interesting that before filing an appeal, the same prosecutor in exactly the same case received a full refusal in the Court of Appeal. 

"The fact is that the prosecutor, knowing the plight of the defendant, is delaying the process in every possible way in order to get money. And this man has no money. If a Turkish citizen had no friends, he would be in a pre-trial detention center. What is the point of our state keeping a foreign citizen? The prosecutor insists on a fine of 170 hryvnias, with a court practice of 000 hryvnias. The defendant was ready to pay a fine of 30 hryvnias — he planned to borrow from someone in order to leave for Turkey as soon as possible. As of today, all of Murat's documents have been confiscated, and we are faced with the fact that he may not be physically admitted to court. In the Court of Appeal, the office refused to accept the application due to the lack of documents. The case constantly requires money: for the translation of documents, for a translator, for a lawyer, not to mention accommodation and transportation," said the tango teacher. 

He noted that the Consulate of Turkey in Odessa is also not personally contributing to the solution of the situation. They do not give official answers for matpomosch or participation in the case.  

"According to my information, the prosecutor is asking for around $4, and the fine to be $000. It will cost him $2 to finish his business and leave our country," Andrey Vozniuk was outraged.

Meanwhile, a 46-year-old citizen of Turkey urgently needs to return to his country, because he is the official guardian of his disabled brother and looks after his elderly mother. He also has two adult children. Now they are students.

During these six months, the man was fired from his job. Without money and work, he is waiting for the hearing of the Court of Appeal, which was scheduled for the end of February 2022.
