From modest incomes to luxury housing: secrets of the Investigative Department

The ElitExpert rating agency continues a series of publications dedicated to the work of investigative bodies and the prosecutor's office. In wartime conditions, any facts that may cast a shadow on individual managers or employees, and therefore on their professional activities, are immediately picked up by the Ukrainian media and cause widespread public publicity.

One of such high-profile cases was the situation with the elite apartment of the head of the Main Investigative Department of the National Police Maksym Tsutskiridze, which was written about by almost everyone leading Ukrainian mass media.

ELITE HOUSING

And indeed — the first and main question that arises in the public when familiarizing with the biography of Maksym Tsutskiridze — where does an official with a modest state salary get the opportunity to buy an elite apartment in the very heart of Kyiv?

A luxurious life can be quite justified - true, if it is a businessman or a politician, but not a civil servant. Therefore, when an official lives in an elite housing complex, and an apartment worth several million hryvnias is registered to his mother-in-law, who has no business and no income, it becomes a matter for reflection.

Tsutskiridze lives (and this is indicated in his Declaration) in an elite residential complex in the very center of Kyiv. As noted in materials of Denys Bigus", an apartment with an area of ​​145 square meters. m registered to Tsutzkiridze's mother-in-law - Lyudmila Zaluzhna.

As "Our Money" writes, in May 2018, she received an apartment with a 30% discount - for UAH 3,68 million. Currently, such apartments cost more than nine million hryvnias. In October 2018, Zaluzhna purchased an additional utility room in this residential complex for UAH 700, and a year later purchased two parking spaces for UAH XNUMX million. But these objects are not indicated in the policeman's declaration.

In general, the mother-in-law of the head of the Main Investigative Department of the National Police, Maksym Tsutskiridze, surprisingly actively invested in real estate. In just a few years, she purchased four objects from the housing complex worth several million hryvnias!

At the same time, Lyudmila Zaluzhna is not engaged in business and does not conduct entrepreneurial activities, she lives in the hinterland of the Kirovohrad region, and it is unlikely that she has unheard of income to buy housing in the center of the capital.

Later, in a comment to the media, Tsutzkiridze explained that his mother-in-law had previously invested in an apartment in another Ukrbud building in the center of Kyiv, then sold it profitably and invested the proceeds in real estate in a new residential complex. However, the journalists never received an explanation about the origin of the funds for the initial purchase of expensive real estate in the center of Kyiv.

But the most important thing in this situation is that the Main Investigative Directorate plays a key role in ensuring security, law and order and protecting the interests of citizens. Therefore, special requirements are put forward to his activity - not only professionalism and responsibility, but also an impeccable reputation.

But if there is even the slightest reason to believe that someone from the management may be involved in any "gray" schemes, it automatically casts doubt on all the investigations that were conducted under his leadership. What confidence can there be in the results of the work of the Investigative Department, if the shadow of doubt falls on the cleaners themselves? The question remains open.

THE CASE OF VADIM CHORNOY

For two years, the law enforcement and judicial system has done nothing to investigate the case related to the theft of corporate rights of Basari LLC and Kompromis SE, which belong to the public organization "Center for the Protection of the Disabled". First of all, we are talking about two Odesa business centers: BC "Kyivskyi" and underground BC "Gretskyi".

The criminal proceedings are being investigated by the Main Investigative Department of the National Police of Ukraine under the leadership of I. Borets, but according to the director of the NGO "Center for the Protection of the Disabled" Arkady Chornyi, the investigation refuses to conduct an investigation; there are more decisions on refusal to conduct investigative actions than the actions themselves; the notary Tatyana Dombrovsbka has not yet been charged with suspicion and she continues to work, although by Order of the Ministry of Justice No. 4677/5, (https://minjust.gov.ua/files/general/2021/12/30/20211230104237-49.pdf) established that her actions were illegal.

"Moreover, the state registrar who registered the fictitious protocol of the general meeting on the change of the director and all the participants of the scheme are at large and continue to own the property of TZI." It is the affected party who is under unreasonable pressure, the property of the organization "Center for the Protection of the Disabled" has become a hostage to the situation, the Order of the Ministry of Justice, which canceled the illegal actions of state registrars, is ignored, and its action is blocked at the request of the prosecutor of the Prosecutor General's Office S. Pylypenko, who is in charge of the investigation." Arkady Chornyi notes.

NGO "Center for the Protection of the Disabled" submitted more than 50 complaints to the court of the Main Investigative Department, regarding the recognition of illegal inaction and illegal decision-making by law enforcement bodies in criminal proceedings, where the NGO "Center for the Protection of the Disabled" as a victim suffered damages in the total amount of UAH 139 million ., caused as a result of criminal acts. But still the investigation cannot investigate a simple crime. In the ElitExpert comment, the law enforcement officers claim that "the pre-trial investigation in the specified criminal proceedings continues" - without any details.

It should be noted that the editors of "ElitExpert" sent several official requests to the leadership of the National Police, as well as to M. Tsutskiridze himself, asking him to express his position on these issues.

"Regarding my place of residence, in accordance with Article 7 of the Law of Ukraine "On Access to Public Information", such information is not open, and in accordance with Article 14 of the Law of Ukraine "On the Protection of Personal Data", its distribution can only be carried out with my consent," said the answers by M. Tsutskiridze.

Instead, NABU and SAP have extended the period for consideration of these requests for another 30 days, after which they must provide their answers on this matter.

Finally, we can add that investors, including foreign ones, were cautious about investing in Ukraine long before the full-scale invasion, which is due to the specifics of the work of the local law enforcement system. This uncertainty is related to the inefficiency and slowness of the legal system when it comes to protecting the rights and interests of investors.

When legal problems or even criminal incidents arise, entrepreneurs often face delays and lengthy investigations, which do not add confidence in the safety of investing funds. This approach aggravates the situation, creating an atmosphere of risk and, of course, affects the attractiveness of Ukraine as an object for investment.

Therefore, it is simply necessary to revise and improve the legal environment on the part of the Ukrainian government in order to create conditions under which investors will feel confident and protected. This is critically important for the stabilization and growth of Ukraine's economy, for attracting necessary investments and strengthening international trust in the country.
