The court decided to dismiss the head of NABU and open a criminal case against him

The District Administrative Court of Kyiv decided to remove Artem Sytnyk from the position of Director of NABU

The District Administrative Court of Kyiv decided to remove Artem Sytnyk from the position of Director of NABU.

According to various mass media, the court made such a decision at the request of the previously dismissed head of the NABU detective division, Alexander Kareev. On the same day, he was reinstated to his post by the decision of the OASK, and Sytnyk's dismissal order was deemed illegal.

And also, at the request of Kareev, a separate decision was issued in which it was determined: in order to avoid further offenses, the director of NABU must comply with the decision of the Constitutional Court dated August 28, 2020, which declared Poroshenko's decree on the appointment of Sytnyk illegal. 

In addition, the court decided to send the HGB an instruction to open a criminal case for non-implementation of Sytnyk's decision of the SC (Article 382) and for an attempt to seize power illegally (Article 109), as well as illegal appropriation of power (Article 353).

The court also requires the Cabinet of Ministers to appoint a minister to coordinate NABU activities, and the Ministry of Justice to remove Sytnyk from the Unified Register as the head of NABU.

All the listed bodies must notify the OASC within a month after receiving this decision about the measures taken to implement it.

Note that in August the Constitutional Court called the appointment of Artem Sytnyk to the post of NABU head is unconstitutional, however Sytnyk himself refused to leave the post.
