The Parliament of Estonia has passed a law that provides for the possibility of marriage between two adults, regardless of their gender, from January 1, 2024. About this reports the ERR.
55 members of the Riigikogu voted for the adoption of the relevant draft law and 34 - against.
The document envisages changing the content of the institution of marriage, known from family legislation, in such a way that in the future marriage can be concluded by two natural persons of legal age, regardless of gender.
In addition to marriage, people also have the opportunity to enter into a cohabitation agreement as an alternative. The new law provides provisions necessary for the implementation of the Law on Cohabitation, which are currently missing in the legal system, and also creates a simplified procedure for the transition from a cohabitation agreement to marriage.
The Family Law also defines the regulation of origin regarding the adoption rights of same-sex couples.
Same-sex couples have been granted the right to joint adoption through marriage equality. A same-sex couple can adopt their spouse's child with the consent of the biological father. The law establishes the principle that a child cannot have more than two parents. The principle according to which the rights and obligations related to the child belong primarily to the child's biological parents is also preserved. The mother's husband has a parental relationship with the child if he consents to the mother's artificial insemination.
