In a comment to the ElitExpert agency, the well-known Odesa lawyer Yevhenii Ivanchenko shared his experience of working in the most complex and interesting cases. According to him, every case he undertakes is unique and interesting in its own way.
"It is difficult to unequivocally answer the question of which case was the most interesting, but I can say for sure that I definitely did not have any uninteresting cases." Ivanchenko noted.
The lawyer spoke about several categories of cases that he particularly remembered.
For example, one of the longest cases was a corporate conflict that lasted about seven years. "Two participants with equal shares in the authorized capital could not divide the once jointly created business for many reasons, including from a legal point of view. But the correct and, most importantly, completely legal approach that was implemented gave its result." Ivanchenko said. To date, no action taken by the legal team has been appealed.
Another important case was a tax dispute, where the State Tax Service of one of the regional centers conducted an illegal audit of the enterprise. "For the company, the results of such an inspection were tantamount to complete bankruptcy, but fruitful work and a built-up defense position made it possible to cancel the conducted inspection." - emphasized the lawyer.
But among the criminal cases Yevgeny Ivanchenko singled out one that did not even reach the court. "Perhaps the most interesting dispute for me is the dispute that did not even reach the court and "died" at the stage of its preparation by law enforcement agencies." he noted. The lawyer managed to convince the law enforcement agencies that the case was hopeless, even at the stage of preparation, which made it possible to avoid a trial for his client.
Also, one of the most interesting cases, according to the lawyer, was a dispute between the state and the company regarding the infliction of large losses due to the illegal use of a plot of land for the development of a sand quarry.
"This dispute was definitely a battle not for life, but for death. The prosecution mobilized the maximum resources of state and local authorities to strengthen its position, but everything was in vain, since the evidence collected by the defense largely outweighed the arguments of the prosecution, Ivanchenko noted. — Later, the decision in favor of the company was confirmed by the Supreme Court."
"The interest, difficulty, tension of all cases in which the state is your opponent always have a different level. But for me, each case is an important part of my professional life." - noted the lawyer.
