Odesa judge Feduleeva deals a blow to Ukraine's defense capability

On Friday, August 5, the Kyiv District Court of Odesa again did not hold a hearing in the case of seizure of documents of the companies "Krupyany Dvir", "Attual" and "Trapeza". The enterprises are located in Odesa and in the conditions of martial law provide at least 40% of the consumers of the Ukrainian market with cereals and salt. These are not just words - their most important role for the country is officially confirmed Order No. 3 of the Ministry of Agrarian Policy of Ukraine dated January 5.01.2022, XNUMX., according to which these companies are listed as strategic because they produce food products that have significant social significance.

However, from July 12, 2022, businesses will be under pressure from law enforcement officers, who have already conducted eight searches. So far, they have removed 90% of the working documentation, thereby practically blocking the production process. At the same time, Volodymyr Pakhomov, legal advisor of the Trapeza company, notes that the police and other bodies that inspect enterprises acted in significant violation of the Criminal Procedure and Criminal Code of Ukraine. Searches were conducted even in the houses of company owners and even children's rooms.

As a result, the court session regarding the seizure of documents was postponed for the third time, which clearly demonstrates the delay of the case on the part of procedural judge Feduleeva. Meanwhile, her inaction is clearly beneficial both to the prosecutor's office, which has committed numerous procedural violations, and to the unscrupulous law enforcement officers who are eagerly waiting for a bribe.

The prolongation of this legal process is a gross violation by the judge of procedural terms. Since the Criminal Procedure Code provides for consideration of the request of investigators to seize property within 72 hours, otherwise the documents are subject to immediate return. To date, the petition has not been considered by the judge, and the documents have not been returned to the company. It should also be noted that the company was searched in a building for which there was no court order.

Note that for gross violations the Disciplinary Chamber of the High Council of Justice, earlier already temporarily eliminated judge Yuliy Feduleev from work. But, apparently, this lesson did not benefit her.

As a result of the actions of law enforcement officers, hundreds of officially employed people may lose their jobs. Among them are a large number of refugees who fled the war, family members of military personnel who are currently defending our country with weapons in their hands, as well as dozens of local residents from a depressed area in which there was no opportunity to find a decent job for many years.

At the same time, as the head of the Prave Dilo human rights association Oleg Mykhaylyk noted, the position of the company's owners is very close to that of human rights defenders:

"They are not going to pay bribes to anyone, they are not going to go anywhere and take their money abroad, they continue their work for the good of the country, provide work for hundreds of people and continue to strengthen the defense capability of Ukraine in all possible ways - but, unfortunately, their forces and opportunities are now significantly limited by investigative actions and seized documentation."

In order to stop this arbitrariness, human rights activists appealed to President Zelenskyi and deputies, sent requests to the Security Service of Ukraine.

Representatives of the Turkish company of the carrier, which also suffered from illegal actions of law enforcement officers, sent a letter to the Ukrainian ambassador in Turkey. The letter states that this company is the second in the Republic of Turkey after the Baykar company, which helps Ukraine not by word, but by deed, and they are outraged by the actions of Ukrainian law enforcement officers.

The next court session is scheduled for August 9, but there is no guarantee that Judge Feduleeva will hold it and make the only correct decision, in this case, the decision to return the confiscated documentation to restore the work of the strategic enterprise.

Probably, only in Ukraine, the defense capability of the state and its image on the international arena depends on the decisions of notorious district court judges.
