The Odesa District Administrative Court satisfied the public's claim regarding the scandalous construction of the coastal zone in the area of the 16th station of Bolshoi Fontana. ElitExpert understood the situation.
Back in 2018, the Department of State Architectural and Construction Control of the Odessa City Council issued a permit to carry out construction works at Mayachny Lanes, 11 and 11-a. The company "Stymax" received a permit for the reconstruction of non-residential premises and recreational facilities for an administrative building, auxiliary facilities and recreation infrastructure. In January 2020, West Building Ukraine LLC was added to the list of developers.
At the same time, instead of a recreation facility, a residential complex "Space on Mayachnoy" began to be built in Mayachnoy Lane.
It is worth noting that the land where the alleged reconstruction was allowed was leased from the "Proizvodstvenno-kommercheskoy firmy named after P. Shmidt" (in Soviet times - Rybkolkhoz named after Shmidt). The lease was issued in 2015. The specified plot with an area of 1,5 thousand square meters is located right on the coast, in fact at the edge of the water, where building housing is expressly prohibited by law. But this did not stop the developer.
At the same time, the public organization "Avtomaidan" appealed to the court to cancel the permit documents and stop the illegal construction of a residential building in Mayachny Lane. On November 23, 2020, the judge of the Odesa District Administrative Court, Oleg Belostotskyi, made a decision to suspend the permit for construction work at the specified address. In addition, the court prohibited the company "Proizvodstvenno-kommercheskaya firma imeni P. Shmidt", LLC "West building Ukraine" or any other enterprise from carrying out work on this land plot.
At the end of 2019, the Department of State Architectural and Building Control of the Odessa City Council, P. Shmidt PKF LLC, and West Building Ukraine LLC filed an appeal with a complaint. On December 21, 2019, the Fifth Administrative Appeals Court decided to open the proceedings. And while this story continues, a concrete box of nahalstroy has already grown on the shore.
The other day, at the end of January 2021, the Odesa District Administrative Court canceled the town-planning conditions issued for the construction of the Prostranstvo residential complex on Mayachny and prohibited any construction work.
The court came to the opinion that the developer "Prostranstvo Development" started large-scale construction instead of renovating the premises.
In view of the revealed circumstances, the court considered that the Department of Town Planning and Architecture of the Odessa City Council illegally issued the State Register of Historic Places. Also, permits for construction work were illegally issued to the developer.
By the way, during the review by the Fifth Administrative Court of Appeal of the case regarding the construction of the Prostranstvo residential complex on Mayachny, the Odessa State Gas Committee supported the developer's position.
We emphasize that the construction of this residential complex was repeatedly accompanied by scandals of various kinds. For example, this is not the first court decision that prohibits construction work. But, despite this, the workers continue to build the complex. In connection with this, law enforcement officers were also called here, however, this did not have the desired effect.
In addition to the fact that a residential complex is being built here under the guise of reconstruction, activists claim that the new building will also prevent Odessa residents from going to the beach. At the same time, the structure itself is located right on the sand by the sea, which also carries lines.
Note that the developer company is associated with the well-known Odessa businessman Alexander Seleznev, who previously headed the infamous Odessa construction company "Progress-stroy". In the mid-2000s, the company went bankrupt, leaving unfinished dozens of unfinished buildings throughout the city, in which all the apartments had already been sold. And now, 15 years later, some of the Progress-stroya houses are still not completed, and people are almost desperate to move into their apartments...
