On January 21, a hearing was held in the Pechersk District Court in Kyiv, at which preventive measures were chosen for three servicemen suspected of improper defense during the offensive in the north of the Kharkiv region in 2024. This was reported by Public from the courtroom.
The first to choose a preventive measure for the suspect, Colonel Ilya Lapin. The prosecutor's request to apply detention for the suspect was granted. The colonel will be held in custody for 60 days.
Lapin's defense attorney, Yuriy Kryvko, told reporters that he would appeal the court's decision.
"My client's wish is to appeal. My belief is also that an appeal should be filed. But the reality is that as far as I know, even before the suspicion was announced, the person in charge indicated on the Internet that the actions were criminal. My client tried to prove in the courtroom that he was doing everything right and good to save people's lives. He took people away from a certain combat zone, believing that their lives needed to be saved. This was May 10, 2024. In practice, this is not a retreat, but a maneuver," — said Kryvko.
After Lapin, a hearing began on the preventive measure for Battalion Commander Yuri Galushkin.
According to the State Bureau of Investigation, the former commanders of the Kharkiv operational-tactical group, the 125th separate territorial defense brigade, and the 415th separate rifle battalion of the 23rd separate mechanized brigade, through their negligent attitude to military service, allowed Russian troops to seize part of the territory of the Lipetsk rural territorial community.
"We are talking about the 125th brigade. The officials who were declared suspicious did not ensure the fortification engineering arrangement of positions in the defense zone. They did not ensure proper organization and management of units during the battle. And such their activities led to the retreat and surrender of positions to the enemy in May 2024 in the Kharkiv region. And we understand that the events, as well as the evidence base and testimony — all this is taking place under martial law and in a combat zone. It is difficult to gather, interrogate a person, or take testimony, or conduct an examination," — said Tetyana Sapyan, communications advisor for the State Bureau of Investigation.
The defendants face up to 10 years in prison.
