The Cabinet of Ministers approved and submitted to the Parliament the final draft of the State Budget for 2025. In particular, the final version of the draft law 12000 provides for a modified norm regarding bonuses for judges of local courts.
The Cabinet of Ministers proposed to pay extra payments to judges instead of bonuses. Thus, Article 41 of the draft law on the State Budget for 2025 is proposed to be editorially clarified as follows:
"To establish that in 2025, in the cases stipulated by the Law of Ukraine "On the Judiciary and the Status of Judges", the judge of the local court within the limits of the funds provided for in the estimate for the judge's remuneration, will be paid a special monthly supplement in the amount of 5 subsistence minimums for able-bodied persons, which is used to determine the basic salary of a judge. Such a special supplement is temporary, is not considered a component of the judge's judicial remuneration, does not apply for the purposes of calculating the previously assigned monthly lifetime allowance and does not affect it.
Thus, it is proposed to establish an additional payment in the amount of 10,5 thousand hryvnias.
Clause 1 of the final provisions of the draft budget proposes to provide that the above-mentioned Article 41 of the Law on the Budget enters into force simultaneously with the entry into force of the law on amendments to the Law "On the Judiciary and the Status of Judges" regarding the payment of a special supplement to a judge of a local court, but not earlier than January 1, 2025 .
The Cabinet of Ministers also indicated that the amount of expenditures for courts, bodies and institutions of the justice system provided for by the State Judicial Administration of Ukraine in the draft of the State Budget of Ukraine for 2025 "enables the implementation of the powers assigned by law to the said bodies."
"Compared to the indicators of 2024, expenditures under the budget program 0501020 in the draft state budget for 2025 were increased by UAH 1,5 billion, of which the general fund by UAH 1,1 billion, the special fund by UAH 0,4 billion" — noted in the Ministry of Finance.
Also taken into account is the proposal to establish that from the budget of the Pension Fund of Ukraine for 2025, expenses for the payment of retrospective court decisions and transferred pensions by court decision are carried out in separate directions according to the sources of their payment. The Cabinet of Ministers is tasked with determining the order of implementation of this norm.
