The Appeals Chamber of the High Anti-Corruption Court overturned the verdict in the "gas case" of former People's Deputy Oleksandr Onyshchenko and ordered a new trial of the case in the first instance. About this reported the Transparency International Ukraine.
In particular, the Administrative Division of the Supreme Court of Justice considered the parties' appeals against Onyshchenko's sentence. According to the results: the appeal of the SAPO prosecutor was dismissed, and the appeals of the defense were partially satisfied.
As reported, before the debate, the prosecutor wanted to return to the previous stage of the trial - clarifying the circumstances and verifying them with evidence. She announced in a statement that she was withdrawing the amended appeal, which contained more demands. Her demands remain the same as in the original appeal - to change the verdict in the part of the confiscation of funds.
The judges of the AP VAKS refused to return to the previous stage and returned the prosecutor's application, as she may later withdraw her complaints in whole or in part.
The defense, speaking in court debates, noted that it considers the verdict illegal and unfounded and therefore requests that it be canceled and the proceedings closed. The defense also drew attention to the violation of the secrecy of the deliberation room during the verdict in the case - at this time the judges participated in educational events, one of the judges was on vacation, and the other was presiding over the judges' meeting.
The Supreme Court of Appeals overturned the verdict and ordered a retrial. The decision was made with a separate opinion from a member of the panel of judges, and the full text of the decision will be announced on May 23.
According to the prosecution, Onyshchenko created a criminal organization in 2013-2016, which allegedly seized UAH 2013 million from the purchase of natural gas at undervalued prices between 2016 and 740. In addition, Onyshchenko was charged with forgery of documents, money laundering, and illegal handling of weapons.
