In Khmelnytskyi region, a senior soldier stabbed another soldier in the stomach, resulting in his death. Sentence in case No. 687/1370/24 issued by the Chemerovets District Court of Khmelnytskyi Region.
The case materials indicate that the tragedy occurred at the end of September 2024 in a dormitory for military personnel.
A senior soldier, a native of Cherkasy region, stabbed another soldier in the stomach, who died from his injuries. Both the attacker and the victim were intoxicated.
Two criminal cases were opened against the attacker under Part 2 of Article 121 of the Criminal Code of Ukraine (causing serious injury that resulted in death) and Part 3 of Article 406 of the Criminal Code of Ukraine (violation of the statutory rules of relations between servicemen in the absence of a relationship of subordination).
The accused partially admitted his guilt, he confirmed that he stabbed the soldier in the stomach, but claimed that he did it in self-defense.
During the investigative experiment, the man said that he and other servicemen consumed alcohol at the unit's temporary location.
The defendant stated that the victim had been beating him that day. He picked up the knife, assuming that the victim would hit him again. Two soldiers confirmed that there had been a verbal conflict between the attacker and the deceased.
The defendant's lawyer requested that his client's actions be reclassified from intentional grievous bodily harm resulting in the victim's death to exceeding the limits of necessary defense. However, the court found that there was insufficient evidence to prove that the defendant's life was in danger.
The court examined all the case materials and found the accused guilty of criminal offenses. He was sentenced to 8 years in prison and ordered to pay UAH 8,5 million in compensation to the mother of the deceased. The term of serving the sentence will be calculated from the moment of his arrest in September 2024. The verdict can still be appealed.
