The Verkhovna Rada of Ukraine adopted the Law 9665, which will allow more effective application of administrative and criminal liability for arbitrary felling of trees and storage of firewood.
The adopted Law adds a new Article 65-2 to the Code of Administrative Offenses of Ukraine, which provides for the establishment of administrative liability for the illegal transportation, storage, sale of trees, shrubs or wood, without documents confirming the legality of the origin of trees, shrubs or wood, or with such documents that are forged, obtained illegally or containing knowingly false information. Such violations will be punished by imposing a fine on citizens from 510 to 15300 UAH, on officials from 3400 to 15300 UAH.
In addition, the Law supplements the Criminal Code of Ukraine with a new article 246-1, which provides for the establishment of criminal liability for the transportation, storage, sale of trees, shrubs or wood without documents confirming the legality of the origin of trees, shrubs or wood, or with such documents that are forged , obtained illegally or containing knowingly false information, committed in a significant amount, shall be punished by a fine of UAH 34000 to UAH 51000 or by restriction of liberty for a term of up to three years, or by deprivation of liberty for the same term.
The same actions, committed repeatedly or with a prior conspiracy by a group of persons, or committed on a large scale, are punishable by a fine from UAH 170 to UAH 000 or imprisonment for a term of five to seven years.
In this article, significant size should be understood as the value of trees, shrubs or wood, which is more than twenty tax-free minimum incomes of citizens, and by large size - more than sixty tax-free minimum incomes of citizens.
This Law is gaining ceremoniality from the day following the day of its publication.
As of November 3, the status of the Law is sent to the President of Ukraine for signature.
