In Ukraine, the review of the decisions of the People's Liberation Army regarding recognition of citizens as unfit for military service is ongoing. According to the statement of the ombudsman Dmytro Lubinets, by the end of September it is planned to check 100% of the conclusions of the VLK in Ukraine.
According to the official, many cases were found when citizens were issued certificates of unfitness due to corruption schemes, while these people had no health problems. At the same time, certificates of limited fitness were issued to citizens with real illnesses. This requires an immediate solution to the problem.
Medical law lawyer Alla Tsymanovska also points to violations on the part of VLK related to incorrect diagnosis and incorrectly established diagnoses. She said there are numerous cases where healthy people have been deemed unfit and forced to seek opportunities abroad, while people with real illnesses have been deemed fit or only marginally fit.
She emphasizes that VLC doctors have the opportunity to manipulate the concepts of "fit", "unfit" and "limited fit", not only by falsifying medical documentation and medical histories, but also by interpreting the diseases themselves. It is emphasized that the degree of manifestation of the disease plays an important role in establishing a diagnosis and determining a person's suitability for military service.
"In practice, many cases are already known that led to certain criminal offenses by VLK doctors, as well as to violations of the rights of some citizens. There are two problems and both need to be solved - preventive measures should be taken to avoid repeating these mistakes in the future," says the lawyer.
According to the human rights defender, there are two completely different stories. In one of them, healthy people were deemed "unfit" and forced to go abroad to build a new life. In another story, really sick people who needed regular treatment were deemed "fit" or "limited fit" for military service.
An important point is the confirmation by the Secretary of the National Security and Defense Council that the terms "fit", "unfit" and "limited fit" sometimes have different interpretations. Therefore, the Council was instructed to clarify the document that determines the level of suitability of men for military service.
