A developer who embezzled more than 22 million hryvnias worth of clients' funds will be tried in Lviv, regional police reported.
As law enforcement officers have established, the head of a housing and construction cooperative took possession of the money of future apartment owners in a residential building that was never built. As a result of the developer's illegal actions, 29 people lost their money.
Thus, in 2020, a 38-year-old resident of Chernivtsi region took the position of head of a service cooperative created for the construction of an apartment building in the city of Vynnyky.
In particular, he concluded agreements with citizens on the payment of monetary contributions, which were to be used for the construction of a real estate object and its commissioning, with the subsequent transfer of the paid apartments into the ownership of the cooperative members.
The future owners paid the full cost of the apartments, however, the head of the cooperative, instead of directing the funds received for construction, partly appropriated them and partly squandered them. Thus, 29 citizens who paid contributions totaling more than 22 million hryvnias were left without apartments and without money.
The pre-trial investigation in the criminal proceedings opened under Part 4, Part 5 of Article 191 (Embezzlement, embezzlement of property or taking possession of it through abuse of official position) of the Criminal Code of Ukraine has been completed. The indictment has been sent to the court for consideration.
The maximum penalty facing the accused is imprisonment for a term of up to twelve years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years and confiscation of property.
By court decision, the attacker's property was seized in order to compensate for the damages.
