The Cabinet of Ministers by its resolution of October 15 № 1175 approved the regulations on the Transparency Register. This Register is created in accordance with the law on lobbying in order to provide free public access to information about lobbying entities and their reporting. The Register is maintained by the National Agency for the Prevention of Corruption (NAZK).
The Register will contain, in particular, data on the amount of funds spent by the lobbying entity for each area of lobbying, with a list of lobbying subjects (in the case when lobbying is carried out in the lobbying entity's own commercial interests or in the commercial interests of the beneficiary without concluding a lobbying contract) in ranges from up to 100 thousand hryvnias to over 10 million hryvnias.
Also, information on meetings and communication with lobbying objects, which occupy a responsible or particularly responsible position within the meaning of the Law "On Prevention of Corruption", during which lobbying was carried out, must be recorded in the Public Register.
It will be recalled that the law on lobbying contains the following definition: "the object of lobbying is the subject of law-making activity (except for the Ukrainian people at the all-Ukrainian referendum, the territorial community at the local referendum) and/or the subject of the law-making initiative". That is, data on meetings with ministers and deputies must be reported in the Register by specifying the following information about lobbying objects: surname, first name, patronymic; position; date of interaction; type of interaction (meeting / event).
The Register will also contain data on the amount of contributions made by the subject of lobbying in support of political parties, contributions to election funds.
The register will start working after the Cabinet of Ministers publishes a corresponding notice in the newspaper "Voice of Ukraine". The financial sources for creating software and technical means of the Register and ensuring its functioning are the state budget and other sources not prohibited by law.
We would like to remind you that from January 1, 2025, Law No. 3606-IX on lobbying will enter into force in Ukraine. However, activities of various public organizations financed by foreign grants and activities related to the implementation of international technical assistance projects will not fall under the definition of lobbying.
During the discussion of draft law 10337 with non-governmental organizations, it was decided that activities in the field of media, electronic communications, activities of political parties, and activities of public associations aimed at influencing subjects of power with the aim of accepting or retaining them will not be considered lobbying. from making decisions by such subjects, ordering a public anti-corruption examination, activities of non-commercial professional organizations, etc. - that is, the law contains a rather wide list of exceptions.
Thus, who will be in this Register in the end is still unknown.
