Officials of territorial recruitment and social support centers (TCS) will be subject to criminal liability of up to 8 years in prison for violating the procedure for conscription of citizens for military service, which led to their deliberate conscription or evasion from military service.
The relevant bill 12442 was recommended by the Verkhovna Rada Committee on Law Enforcement Activities on February 19 to be adopted as a basis by the parliament.
As Maksym Buzhansky noted, the bill provides for the liability of the CCC for the illegal mobilization of citizens, and the liability of members of the VLK for the illegal recognition of the sick as healthy and vice versa.
According to the draft law, during martial law, heads and members of the Military Commissariat for Military Service for intentional violation of the procedure for conducting a medical examination (military medical examination) to determine the health suitability for military service, which led to the conscription of a citizen who is not subject to such conscription due to health conditions, as well as led to the exemption from conscription of a citizen or the exemption of a citizen from military service due to health conditions, will be subject to liability in the form of imprisonment for a term of 3 to 8 years with deprivation of the right to hold certain positions or engage in certain activities for a term of one to 3 years.
For officials of the CCC, violation of the procedure for conscription of a citizen for military service, which led to the conscription of a citizen who is not subject to such conscription, or the illegal exemption of a citizen from conscription for military service, committed under martial law, will be punishable by imprisonment for a term of 3 to 8 years with deprivation of the right to hold certain positions or engage in certain activities for a term of one to 3 years.
It is proposed to supplement the Criminal Code with the relevant provisions on punishment. These are new articles 337-1 "Violation of the procedure for conducting a medical examination (military medical examination) to determine fitness for military service" and 426-2 "Violation by a military official of the procedure for conscription (admission) of citizens for military service."
Earlier, the Verkhovna Rada Committee on National Security and Law Enforcement held a joint meeting, during which the facts of illegal actions by officials of the CCC were discussed - the use of violence, obstruction of the activities of lawyers, and the creation of checkpoints without appropriate documents.
