NABU and SAPO referred the case to court regarding fraud during the trade in seized property transferred to the National Agency of Ukraine for the Identification, Tracing and Management of Assets Obtained from Corruption and Other Crimes (ARMA).
11 people will be tried, including the head of an organized crime group (OCG), the former head of SE "SETAM" (2016-2020), the former head of ARMA (2016-2019), and the head of the Asset Management Department of the central apparatus of ARMA (2018-2020).
According to the investigation, the head of the OZG during 2017-2018 developed a corruption scheme for the sale of seized property. As a person who for several years had an indirect influence on the formation and implementation of the state legal policy of the Ministry of Justice of Ukraine, ARMA itself and SE "SETAM", the head of the OZG was well aware of the specifics of this area of the Agency's activity. He developed a plan that provided for the establishment of control over all stages: from the moment of transfer of material evidence to ARMA to their sale at an understated cost on a controlled trading platform to controlled companies.
The head of ARMA, as a participant in the crime, for his part ensured the adoption of the necessary regulatory framework, which allowed creating the appearance of legality of manipulations with seized property in the interests of the OZG. One of the steps was a competition to select a trading platform, under the terms of which only one structure could win - SE "SETAM", the general director of which was also involved by the organizer in the OZG. He could ensure the conduct of electronic auctions for the sale of seized property at reduced prices to previously determined companies.
Thus, the four-person OZG participants, together with seven other established participants of the scheme, successfully implemented it at least four times during 2019.
It is about selling:
- three land plots in the Odessa region, purchased at one time for the construction of shopping centers, were sold 18 times cheaper than the market value;
- 2,6 thousand tons of medium and fine river sand in the Kyiv region - underestimation of the cost by more than 6 times compared to the market price;
- over 4,5 thousand tons of urea – almost 5 times cheaper than market prices;
- grains, cereals and oilseeds – four times cheaper than the market price.
After receiving the final conclusions of the forensic examinations, the amount of damages caused is over 440 million.
