A father of three children does not necessarily have the right to deferment — TCC

Clause 3 of Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization" specifies that men with three or more dependent children under the age of 18 have the right to deferment.

"However, the text immediately defines "except for those who have arrears for the payment of alimony, the total amount of which exceeds the amount of payments for three months."

Also, the father does not have the right to postponement if he does not live with his children and does not pay alimony at all, because the text of the Law contains the wording "who have three or more dependent children". That is, by itself, the entry in the birth certificate of a conscript as a father does not give him the right to deferment - the father must support his children", the message says.

Also, a husband does not have the right to a deferment if he is raising an adopted child, but the natural father pays alimony. Since in this case the child is dependent on the biological father.

Every conscript man who has the right to deferment will definitely receive it. To do this, you need to personally submit an application to the head of the commission of the TCC and SP at the place of military registration. The application form is defined in Appendix 4 of the Resolution of the Cabinet of Ministers of Ukraine. The application must be accompanied by supporting documents, the list of which is specified in Appendix 5 of the same Resolution.
