In Ukraine, a law came into force on December 4, which significantly changes the approach to booking employees of the defense-industrial complex and critical enterprises.
A new employee booking procedure is now in place — in accordance to the Law of Ukraine "On Amendments to Certain Laws on Labor Relations under Martial Law"
From now on, defense-industrial complex companies and organizations with critical status can reserve employees without restrictions on quantity. Previously, there was a percentage limit. The innovation will allow businesses to maintain full staff if it is necessary for their operations.
As it became known from the law, the changes also apply to employees, who have problems with their military records or those who have not updated their personal data. If previously they could be denied a reservation because of this, now such employees can also be booked.
Businesses can book workers:
- without military registration documents or with errors in them;
- those who are not registered in the military;
- those who have not specified their personal data;
- who are wanted for violating military registration rules or mobilization legislation.
It is important that these employees are granted a reservation for a maximum of 45 calendar days from the date of employment. The probationary period cannot exceed this amount either. Such temporary reservation is granted only once per calendar year.
During this period, those booked must put their documents in order and remove themselves from the wanted list. If this is not done, the employer will be able to legally fire the booked employee after these 45 days.
Please note that a reservation does not exempt mobilization violators from fines. That is, even if you receive a reservation, you will have to pay them.

Reservation is subject to representatives of certain professions and services, which are defined by Article 25 of the Law of Ukraine "On Mobilization Training and Mobilization". Reservations are given to conscripts who work or serve:
- in state authorities, other state bodies or local self-government bodies;
- in state bodies, the National Police, NABU, SBI, the Prosecutor's Office, the Bureau of Economic Security, the State Emergency Service, the Criminal Enforcement Service, the Court Protection Service, courts, other legal structures, as well as in full-time positions in patronage services of state bodies;
- at enterprises, institutions and organizations that perform mobilization tasks;
- at enterprises and organizations that are critical to the work of the army, other military formations or the economy, ensuring the vital activity of the population during a special period. This includes the ultimate owners of such enterprises, even if they do not work for them.
