The Cabinet of Ministers has established limiting coefficients for the payment of special pensions to customs officers, civil servants, prosecutors, people's deputies, members of the government, diplomats and others. Such coefficients will be applied if the pension is greater than UAH 23.
The Government made the corresponding changes by resolution from January 3, 2025 No. 1 "On determining the procedure for paying pensions to certain categories of persons in 2025 during martial law".
Below is the text of the resolution.
In accordance with Article 46 of the Law "On the State Budget of Ukraine for 2025", the Cabinet of Ministers of Ukraine decrees:
- To establish that during the period of martial law in 2025, pensions (retirement payments), assigned (listed) in accordance with the Customs Code of Ukraine, the Laws of Ukraine "On the Civil Service", "On the Prosecutor's Office", "On the Status of the People's Deputy of Ukraine", "On the National Bank of Ukraine", "About the Cabinet of Ministers of Ukraine", "About diplomatic service", "About service in local self-government bodies", "About forensic examination", "About status and social protection of citizens who suffered as a result of the Chernobyl disaster", "On state support of mass media and social protection of journalists", "On scientific and scientific and technical activities", "On pension provision of persons released from military service and certain other persons", Resolutions of the Verkhovna Rada of Ukraine from October 13, 1995 No. 379/95-BP "On the approval of the Regulation on the assistant-consultant of the people's deputy of Ukraine" (taking into account allowances, promotions, additional pension, targeted cash assistance, pension for special services to Ukraine, indexation and other pension supplements established by law), the amount of which exceeds 10 amounts of the subsistence minimum, established for persons who have lost working capacity, are paid with the application of coefficients to the corresponding amounts of the excess:
- to the part of the pension (retirement payment) that exceeds 10 amounts of the subsistence minimum established for persons who have lost working capacity, and does not exceed 11 amounts of the subsistence minimum established for persons who have lost working capacity, — 0,5;
- to the part of the pension (retirement payment) that exceeds 11 amounts of the subsistence minimum established for persons who have lost working capacity, and does not exceed 13 amounts of the subsistence minimum established for persons who have lost working capacity, — 0,4;
- to the part of the pension (retirement payment) that exceeds 13 amounts of the subsistence minimum established for persons who have lost working capacity, and does not exceed 17 amounts of the subsistence minimum established for persons who have lost working capacity, — 0,3;
- to the part of the pension (retirement payment) that exceeds 17 amounts of the subsistence minimum established for persons who have lost working capacity, and does not exceed 21 amounts of the subsistence minimum established for persons who have lost working capacity, — 0,2;
- to the part of the pension (retirement payment) that exceeds 21 the amount of the subsistence minimum established for persons who have lost their ability to work, — 0,1.
For persons to whom pensions have been assigned (enumerated) in accordance with the legislative acts specified in the first paragraph of this clause, and who are entitled to a pension in accordance with the Law of Ukraine "On Mandatory State Pension Insurance", and in whom the amount of the pension calculated in accordance with of the first part of Article 27, the second paragraph of the first part of Article 28 and Article 29 of the Law of Ukraine "On Mandatory State Pension Insurance", exceeds 10 amounts of subsistence allowance of the minimum established for persons who have lost their ability to work, the coefficients are applied to the corresponding amounts of the excess of the pension assigned (calculated) in accordance with the legislative acts specified in the first paragraph of this clause, over the amount of the pension calculated in accordance with the first part of Article 27, the second paragraph of the first part Article 28 and Article 29 of the Law of Ukraine "On Mandatory State Pension Insurance".
- Establish that during the period of martial law in 2025, the coefficients specified in paragraph 1 of this resolution shall not be applied to pensions (pension payments) of persons who took a direct part in the anti-terrorist operation, ensuring its implementation, being directly in the areas of the anti-terrorist operation during its implementation , direct participation in the implementation of measures to ensure national security and defense, repel and deter armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their implementation, being directly in the districts and during the implementation of the specified measures, took direct part in the measures necessary to ensure the defense of Ukraine, the protection of the safety of the population and the interests of the state in connection with the military aggression of the Russian Federation against Ukraine, being directly in the districts and during the implementation of the specified measures, as well as to pensions in the event of the loss of a breadwinner, assigned to family members of the deceased (deceased, missing persons) of such persons.
- This resolution enters into force on the day of its publication and applies from January 1, 2025.
